This is an appeal from an order denying the defendants motion for summary judgment. The complaint of Ralph A. Dottai, a policeman in the city of Sheboygan, alleges he was injured while rescuing a person from a fire occurring in a building owned by the defendants Edward J. Altenbach and Frieda Altenbach, his wife. The building contained two business establishments on the first floor and two family apartments on the second floor. The fire started on February 28, 1961, in the watch shop of the defendant Henry C. Mertz, Jr., on the first floor and spread to the lower part of the stairway leading to the second-floor apartments. The plaintiff while on duty became aware of the peril of two second-floor tenants and rescued one of them from a second-floor window by the use of a ladder set up outside the building. While in the act of rescuing another occupant from the window, an explosion occurred within the building knocking the plaintiff to the ground. The complaint also alleges the defendants Altenbach, as owners of the building, were negligent in violating the safe-place statute in several respects including violations of the Building Code requirement of two exits and of the Inflammable Liquids Code.
